Harrigan Leyh Caps Five Week Jury Trial Win by Prevailing on All Post-Trial Motions
Capping a significant win at trial, on August 1, HLFT client Whitepages, Inc., prevailed on all post-trial motions in a lawsuit brought by competitor Spokeo, Inc.
In February, the five-week trial ended with the jury finding in favor of Whitepages on four of Spokeo’s five claims, awarding Spokeo only 0.26% of the $27 million it claimed in damages, and finding in favor of Whitepages on its counterclaim. Post-trial, the Court agreed with HLFT attorneys Timothy Leyh, Tyler Farmer, and Kristin Ballinger that the Consumer Protection Act did not apply, reversing the jury’s verdict on the single claim on which Spokeo had prevailed. In addition, the Court awarded Whitepages over $2 million in attorneys’ fees and costs incurred defending against Spokeo’s breach of contract claims.
