Harrigan Leyh Prevails After 5 Week Jury Trial
The plaintiff sought $27.2M in damages. The trial lasted five weeks. When the jury expressed frustration at the pace of the plaintiff’s presentation of evidence, HLFT and the client decided to streamline its case into a handful of days of fact and expert witness testimony.
Soundly rejecting nearly all of the plaintiff’s claims (for alleged breach of contract, negligent misrepresentation, and fraud), the jury awarded only $72,000 in damages for the plaintiff’s claim under RCW chapter 19.86 (i.e., an award of 0.26% of the amount sought). The jury also found the plaintiff liable for breach of contract.
HLFT will pursue the client’s contractual right to attorneys’ fees incurred in its successful defense and prosecution of the claims, seek dismissal of the one successful claim, and defend the verdict on appeal.
