Jessica is an experienced litigator licensed in both Washington (2016) and Australia (2008).  She has represented clients in a wide range of industries including mining and resources, telecommunications, industrial packaging, financial services and media and entertainment. She has appeared in high stakes litigation in cases involving copyright and trademark infringement, misleading and deceptive trade practices, breach of contract and trade secret enforcement. 

 Jessica also has significant experience in patent infringement and revocation matters across a wide range of complex technologies in various scientific fields.  

The following is a small but representative list of Jessica’s recent engagements.

SNF Australia Pty Ltd v Ciba Specialty Water Treatments (Patent); Successfully defended Ciba Specialty Water Treatments (now BASF) in patent infringement and revocation proceedings involving the technology used in the disposal of mine tailings;

Aristocrat Technologies Australia Pty Ltd v Global Gaming Supplies Pty Ltd (Copyright, Trademarks); Acted for Aristocrat in Federal Court proceedings involving the importation and sale of counterfeit gaming machines in South America

Phonographic Performance Company of Australia Limited & Ors v Commonwealth of Australia & Ors (Copyright, Constitutional); Represented the recording industry in High Court proceedings (equivalent of the US Supreme Court) regarding the constitutionality of provisions of the Copyright Act which cap the royalty payable to artists in Australia. 

Orient Capital Pty Ltd v Thomson Reuters (Professional) Australia Pty Ltd (Trade Secrets, breach of confidential information); Acting for Thomson Reuters in defending allegations of misuse of trade secrets and breaches of confidential information in relation to Orient Capital’s proprietary software 

Seven Network Limited v News Limited (Consumer Law, Antitrust). Successfully represented News Limited and others in the largest trade practices case conducted in the Australian courts at the time regarding allegations of misuse of market power, price fixing and misleading and deceptive trade practices by the television industry in Australia.
